Terms of use

Introduction

In these terms and conditions and in the privacy statement set out below, ME Group Australia, a wholly-owned subsidiary of ME Group International plc is referred to as ‘we’, ‘us’ or ‘our’.

Below are set out the terms and conditions applicable to use by a customer (referred to as ‘you’, and ‘your’) who uses any of our photo booths (a ‘Photobooth’). By using a Photobooth, you will be deemed to accept these terms and conditions.

Use

You will not use a Photobooth for (i) any unlawful purpose, or (ii) any purposes unconnected with the taking of your photograph by the Photobooth.

Title to, and Copyright in, The Product

So long as you pay the full price for the product, title to, and copyright in, the photograph produced by the Photobooth (‘product’ or ‘photographs’) belongs to you immediately the photograph is produced. We do not keep any copy of photographs produced by the Photobooth except for the purpose of transferring the photos digitally to an official Government service on your instructions, after which the photo is permanently deleted from our systems.

Refunding customers, and limitation on our liability to you

In the rare cases of the Photobooth producing photographs that are not of satisfactory quality, our maximum liability, and your sole remedy, for defective products sold by a Photobooth, whether such liability is in contract, negligence (or delict in Scotland), statute or otherwise at law is as follows.

You will be entitled to a refund of the price of the photos. To seek a refund, you may contact us by:

(i) writing to our Australia Customer Service Department, 5/11 Davies Rd, Padstow NSW 2211; or
(ii) emailing info@me-group.au; or
(iii) phoning 1300 791 730

We will normally issue a full refund for a single set of photographs on a ‘no-quibble’ basis but reserves the right to you to send in the photographs to support the claim for a single set refund, multiple purchases or if we have previously paid you a refund. This is to enable us to assess the alleged problems with the photographs. Where we exercise this right, we will also refund to you the cost of sending us the photographs by ordinary first-class post, provided we decide that a refund is due on the photographs.

Where you phone our call centre, we may ask you to write in if we have any difficulty understanding you, so we can make sure the refund is issued correctly.

Indirect and consequential losses

In no event will we have any liability whatsoever for any indirect or consequential loss incurred by you or anyone for whom you may be acting howsoever that loss may be caused and regardless of whether we have or are deemed to have any knowledge that non-production of a photograph or a defect or problem with any photograph would or is likely to give rise to such loss. Non-exhaustive examples of such indirect losses include (i) travel fares incurred by you for the purpose of going elsewhere to have your photos taken, (ii) the cost of someone else taking the photos, and (iii) cancellation of, or changes to, trips of any kind.

Statutory rights

None of the above in any way affects our liability for death or personal injury due to its negligence, or any other liability that the law prevents us from limiting or excluding.

Where you deal as a consumer, none of the above affects your statutory rights.

These terms and conditions are governed by the laws of Australia.

Privacy Statement

We respect people’s right to privacy, and we comply with our obligations under relevant data protection laws. We are committed to ensuring that your privacy is protected. This Statement of Privacy applies to this website and governs data collection and usage. Should we ask you to provide certain information by which you can be identified when using a Photobooth and this website, we will only use that information in accordance with this Statement of Privacy.

This Statement of Privacy is for the purpose of customers using a Photobooth and technology for the capture and transfer of their image to www.gov.uk passport services for the renewal of their passport. The photo captured shall only be used for this purpose and will not be used or shared with anyone for any other purpose. We shall delete from our systems any photos captured by a ME Group one month from the date of capture.

By using our photo booths and visiting our website, you are deemed to accept the terms of this privacy statement and the data practices described within.

Collection of your personal information

We shall not collect personally identifiable information, other than, in certain cases, credit card information. Such information is only collected from you if you voluntarily submit it to us and is only used with the express purpose of acquiring payment services on your behalf. We do not keep it on record in our systems.

Any other information received from you after the use of a Photobooth for customer service reasons. i.e. name, address, phone number, email, etc. will only be used for the handling of your query and not for any other purpose.

Use of your personal information

We collect and use your image to deliver the services you have asked for, such as the capture and transfer of your image to the www.gov.au passport services for the renewal of your passport. Any other information received after you use a Photobooth for customer service reasons, e.g. name, address, phone number, email, etc. will only be used for the handling of a customer’s query, complaint, etc. and not for any other purpose. All data is held within Australia.

We do not use or disclose sensitive personal information, such as race or ethnic origin, religion, or medical conditions, without your prior express consent.

We may disclose your personal information, without notice, only if we are required to do so by law or if we believe in good faith belief that such action is necessary to: (a) comply with the law or with legal process served on us; (b) protect and defend our rights or property; and, (c) act under exigent circumstances to protect the personal safety of our customers or the public.

Security of your personal information

We secure your personal information from unauthorized access, use or disclosure. All photos that we capture shall be deleted one month from the date of capture. We secure the personally identifiable information you provide on computer servers in a controlled, secure environment, protected from unauthorized access, use or disclosure. All personal data is held securely within Australia.

Website development

The Photo Me Australia website was developed by the website agency Hatch Digital.

Changes to this statement

We will occasionally update this Statement of Privacy to reflect company and customer feedback. We encourage you to periodically review this Statement to be informed of how we protect your information.

What we can do for you

In Australia, we are expanding for you to find us in supermarkets, shopping malls, post offices, high street retailers, larger railway stations, and other major transport hubs.
Our photos comply with the International Civil Aviation Organisation (ICAO) standards. Therefore, we can provide ID photos with officially recognised quality, applicable for documents including passports and visas.
